Copyright Policy

Which app this covers. This Copyright Policy applies to the Ask Lucilla app (com.lucilla.rewards) and its text-message service. The Lucilla fitness app has its own Copyright Policy. Notices for either app go to the same DMCA agent below.

Lucilla respects the intellectual property rights of others and expects users and businesses to do the same. This page explains who owns what within Ask Lucilla, how to report copyright infringement under the U.S. Digital Millennium Copyright Act (DMCA) and similar international laws, and how to dispute a takedown.

1. Lucilla's Copyrighted Material

2. User and Business Content

You own the copyright in content you create and submit in Ask Lucilla (reviews, photos, messages, reward listings, menus, business profile content, etc.). Businesses are responsible for holding the rights to the logos, photos, menus, and other material they upload or text to us. By submitting content, you grant Lucilla a limited license to host, display, and distribute it within the platform — see our License Agreement, Section 3 for full scope.

3. Reporting Copyright Infringement (DMCA Notice)

If you believe content on Ask Lucilla infringes your copyright, you may submit a takedown notice. Per 17 U.S.C. § 512(c)(3), your notice must include:

  1. A physical or electronic signature of a person authorized to act on behalf of the copyright owner
  2. Identification of the copyrighted work claimed to have been infringed (or a representative list if multiple works)
  3. Identification of the allegedly infringing material — including its location (URL, business name, username, or reward ID) — sufficient to permit us to locate it
  4. Your contact information: name, address, telephone number, and email
  5. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law
  6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf

We aim to respond to valid takedown notices within 3–5 business days.

4. Counter-Notification

If your content was removed in error, you may file a counter-notification under 17 U.S.C. § 512(g) by sending the following to social@lucilla.ca:

  1. Your physical or electronic signature
  2. Identification of the material that was removed and the location it appeared before removal
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed by mistake or misidentification
  4. Your name, address, and telephone number
  5. A statement that you consent to the jurisdiction of the federal court in your judicial district (or the District of Delaware if outside the U.S.) and that you will accept service of process from the original DMCA filer or their agent

If we receive a valid counter-notice, we may restore the content unless the original filer obtains a court order against you within 10–14 business days.

5. Repeat Infringer Policy

Lucilla terminates accounts of users and businesses we determine to be repeat infringers in accordance with 17 U.S.C. § 512(i). Termination decisions consider context, scale, and intent. Users with terminated accounts cannot create new Lucilla accounts.

6. Trademark and Brand Inquiries

The Lucilla name, "L" galaxy logo, and related brand elements are trademarks of Lucilla, Inc. Use of any Lucilla trademark requires written permission. To request a license, partnership, or co-marketing arrangement, email social@lucilla.ca.

If a business listing on Ask Lucilla uses your trademark without authorization, report it to the same address with the listing name and your registration details.

7. False Claims

Filing a false DMCA notice or counter-notice is a federal crime under 17 U.S.C. § 512(f), punishable by damages including costs and attorneys' fees. If you are not certain whether use of a work is authorized, consult an attorney before filing.

8. Updates to This Policy

We may update this Copyright Policy as our platform evolves or as law requires. Material changes will be announced via in-app notification and email to registered users. Continued use after changes constitutes acceptance.
